PERI 3D Construction (hereinafter referred to as “PERI”, “PERI 3D Construction”, “we”, “us”, or “our”) is committed to respecting your privacy. In order to ensure transparency, we have developed this Privacy Notice (hereinafter referred to as “this Notice”) to clearly communicate how we collect, use, disclose, protect, store, and transfer your personal data. We ask that you take a moment to carefully read this Notice. If you have any questions or concerns, please feel free to contact us.

This Notice applies to PERI’s business interactions with our prospective and existing customers, suppliers, other business partners, as well as visitors to our websites and social media channels.

2 Types of Data Collected and Processed

The personal data we collect and process depends on the context of your interactions with us and the services you use. Categories of personal data that we collect and process include, for example:

Contact and company information:
Full name, job title, salutation, position, company name, registration details, telephone number, email address, postal address, fax number, communication preferences, and records of correspondence.

Transaction information:
Information relating to orders, quotations, products or services, payments, tax identification numbers, shipping information, signed agreements, and billing data.

User account information:
Account name, email address, user ID, login credentials, preferences, profiles, and activity logs.

Website usage and technical data:
IP address, browser type, device identifiers, session data, cookies, and other online identifiers.

Personal image:
Photographs and video recordings.

Social media information:
Social media usernames, profiles, posts, comments, and other interactions with our social media channels.

Event participation information:
Information related to participation in events such as trade fairs, trainings, or other online/offline campaigns, including registration details, preferences, feedback, and travel bookings.

We may obtain data about you from publicly and commercially available sources or collect data about you via third-party services, in each case to the extent permitted by applicable law. This may include, among others, social media platforms, company profile databases, tenders, public registers, and other PERI group companies.

 

3 Purposes and Use of Data Processing

In order to provide the services requested by you and to fulfill our contractual obligations towards you and/or our legal obligations, we process the following personal data for the respective purposes. Unless otherwise stated in this Privacy Notice, you may no longer be able to use the respective services and we may no longer be able to fully or partially perform the contract if you object to or restrict the collection and processing of your personal data for these purposes.

Contract fulfillment and orders:
We process your contact and company information, transaction information, and user account information in order to manage contracts, conduct due diligence, process invoicing and accounting, deliver products and services, and provide customer service.

Account management:
We process your user account information in order to create and manage your user account, including access to our services. If you have enabled the single sign-on function (e.g., via Microsoft or Google), your login credentials remain with the provider and are not transmitted to us. Please refer to the terms and conditions of your provider (e.g., Microsoft Single Sign-On) for further details.

Event registration:
We process your contact and company information as well as event participation information in order to handle your requests, register you for events, fulfill event-related conditions, and organize activities such as event-specific competitions or prize draws.

For purposes related to our legitimate (commercial) interests, we process the following categories of personal data for the corresponding purposes.

Customer support:
We may process your contact and company information, transaction information, user account information, social media information, and event participation information in order to respond to inquiries regarding our products, services, or events in which you are involved.

Marketing and promotional activities:
We may process your contact and company information, social media information, and personal image in order to conduct marketing and promotional activities. This often includes taking group photos or videos at events you have attended, sharing information about our products, services, and events similar to those you have previously ordered from us, obtaining your feedback, sending printed brochures, and posting or interacting with you on social media platforms or websites.

Technical operation and maintenance:
We may process your user account information, website usage and technical data, and other non-personal metadata in order to perform technical operation and maintenance tasks and implement security measures to ensure the smooth and secure use of our products and services.

Improving customer experience and business analysis:
We may process your contact and company information, transaction information, user account information, website usage and technical data, social media information, and event participation information to conduct business analysis, risk management, internal learning, and statistical reporting in order to provide you with the best possible products and services. Before processing for these purposes, we apply pseudonymization or anonymization wherever possible and adhere to the principles of “Privacy by Design” and “Privacy by Default”.

Based on your consent, we process the following personal data for the related purposes. You may withdraw your consent at any time with effect for the future. The lawfulness of processing carried out prior to the withdrawal remains unaffected.

Direct marketing:
With your consent, we process your contact and company information for direct marketing purposes, such as newsletters or customer satisfaction surveys. You may withdraw your consent at any time by clicking the “unsubscribe” button in our communications or by contacting the indicated contact point.

Commercial use of personal images:
With your consent, we may take close-up photographs of you and publish your personal images on our company’s social media channels, websites, or other media for brand communication and the sharing of success stories. You may withdraw your consent at any time in accordance with the conditions set out in the signed consent declaration by contacting your PERI contact person.

In addition, we may process your personal data where necessary to comply with legal obligations, including responding to data subject requests, fulfilling tax and accounting requirements, as well as for the establishment, exercise, or defense of legal claims and for the prevention, detection, and prosecution of potential fraud or cyberattacks.

4 Cookies and Similar Technologies

In our online services we use “cookies” – a term that includes not only traditional small text files stored on your device, but also other similar technologies such as pixel technologies and log file analysis. These cookies and technologies support various functions and tracking capabilities during your visit to our website.

We categorize our cookies according to their necessity: essential cookies are indispensable for the technical operation of our services, whereas functional and marketing cookies are not. 4.5 Use of Google Analytics

We use Google Analytics to analyze the use of our website. The data obtained from this is used to optimize our website and advertising activities.

Google Analytics is provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). Google processes the data relating to website usage on our behalf and contractually commits to measures to ensure the security and confidentiality of the processed data.

During your visit to our website, the following data may be recorded, among others:

  • Pages visited

  • Orders including revenue and ordered products

  • Achievement of “website goals” (e.g. contact inquiries or newsletter subscriptions)

  • Your behavior on the pages (e.g. time spent on pages, clicks, scrolling behavior)

  • Your approximate location (country and city)

  • Your IP address (in abbreviated form so that it cannot be clearly assigned)

  • Technical information such as browser type, internet service provider, device, and screen resolution

  • The source of your visit (i.e. which website or advertising medium you used to reach us)

Personal data such as your name, address, or contact details are never transmitted to Google Analytics.

This data is transmitted to Google servers in the United States. Please note that in the United States the same level of data protection as within the European Union may not be guaranteed.

Google Analytics stores cookies in your web browser for a period of two years from your last visit. These cookies contain a randomly generated user ID that allows you to be recognized during future visits to the website.

The recorded data is stored together with the randomly generated user ID, which enables the evaluation of pseudonymous user profiles. These user-related data are automatically deleted after two months. Other data remain stored in aggregated form indefinitely.

If you do not agree with this data collection, you can prevent it by installing the browser add-on to disable Google Analytics or by rejecting cookies via our cookie settings dialog.
 

4.6 Use of Google Ads

We use Google Ads, an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when users enter certain search terms in Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on the user data available at Google (e.g. location data and interests) (audience targeting).

As the website operator, we can evaluate these data quantitatively, for example by analyzing which search terms triggered the display of our advertisements and how many advertisements resulted in corresponding clicks.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent may be withdrawn at any time.

4.7 Google Conversion Tracking

This website uses Google Conversion Tracking. The service provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

With the help of Google Conversion Tracking, Google and we can recognize whether a user has performed certain actions. For example, we can evaluate which buttons on our website are clicked how frequently and which products are viewed or purchased particularly often. This information is used to compile conversion statistics. We receive the total number of users who have clicked on our advertisements and which actions they performed. We do not receive any information that allows us to personally identify users. Google itself uses cookies or comparable recognition technologies for identification purposes.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent may be withdrawn at any time.

4.8 Use of Google Maps

Our website uses the Google Maps mapping service to display interactive maps. This service is operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Maps is not automatically loaded on our website. For data protection reasons, a connection to Google’s servers is only established after you have consented to the use of the relevant cookies (category: “External Media” or “Google Services”). Consent is obtained through our cookie consent banner when you first visit the website.

Only after your active consent is the map loaded and personal data (e.g. your IP address and possibly location data) may be transmitted to and stored by Google. We have no influence on the further processing of data by Google.

Legal basis:
Your data are processed on the basis of your consent pursuant to Art. 6(1)(a) GDPR. Consent is voluntary and may be withdrawn at any time via the cookie settings.
 

4.9 Use of the Facebook Pixel

This website uses the visitor action pixel of Facebook to measure conversions. The provider of this service is Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, however, the collected data are also transferred to the United States and other third countries.

This allows the behavior of website visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. This enables the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and helps optimize future advertising activities.

The data collected are anonymous for us as the operator of this website; we cannot draw conclusions about the identity of users. However, the data are stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook may use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy. This allows Facebook to display advertisements on Facebook pages and outside of Facebook. We, as the website operator, cannot influence this use of the data.

4.9.2 Use of the LinkedIn Insight Tag

With your consent, we activate a LinkedIn cookie when you visit our website (LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland).

The LinkedIn Insight Tag reports to LinkedIn which actions you perform on our website and may transmit data that could potentially identify you. Based on this data, LinkedIn can recognize that you have visited our website, what you have clicked on, and whether you clicked on a link on LinkedIn that led you to our website.

This enables LinkedIn to display interest-based content and advertisements. LinkedIn may associate these data with your user account and use them for its own purposes.

We do not receive personal data about you or other LinkedIn users. 5 Social Plugins and Social Media

At PERI, we enhance our services through the integration of social plugins, such as social media icons and “Like” buttons, from various social networks. It is important to note that these plugins are disabled by default and are only activated once you explicitly choose to enable them. This ensures that you retain full control over how your data are shared.

We strongly recommend that you first familiarize yourself with the data processing practices of these platforms before activating the social plugins. This proactive approach ensures that you are well informed about how these platforms use your data.

6 Data Disclosure and Transfers

Disclosure to Service Providers

We work with internal group service providers and external service providers, including payment service providers, IT support providers (including various IT services such as digital workplace solutions, ERP systems, and AI services for administrative support, e.g., translation), customer service agencies, warehouse service providers, marketing agencies, campaign organizers, and repair companies, in order to provide you with the best possible and seamless services.

These service providers only have access to your personal data to the extent necessary to fulfill their contractual obligations towards us. Our service providers have been carefully selected and commissioned and are contractually bound. They will not process your personal data for other purposes.

We may disclose your personal data to our parent company and any subsidiaries or affiliated companies of our parent company.

We may disclose your personal data to our contractors and service providers pursuant to a written contract between us and each contractor or service provider. Each service provider is a for-profit entity that processes the data on our behalf.

We may use your personal data for our own business purposes, such as internal research for technological development and demonstration. This will not be considered a “sale” of your personal data.

Disclosure to Third Parties

We only disclose your personal data to third parties when this is necessary to provide the services requested by you.

For example:

  • Your contact and company information may be shared with logistics service providers or product manufacturers to deliver or collect equipment and products.

Internal PERI Group Transfers

In cases where a local business contact is required at your request or due to your expressed interest, your contact and company information may be shared with the respective PERI Group company in your country in order to best handle your request or interest.

This may also include scenarios where a PERI Group company sells products or services on behalf of another PERI Group company. In such cases, your contact and company information, user account information, and transaction information may be shared with the relevant PERI Group company for purposes such as order processing, license registration, or service activation.

Legal or Regulatory Disclosures

PERI may disclose your personal data in order to comply with applicable laws and regulations, respond to requests from supervisory authorities, courts, or governmental authorities, or to establish, exercise, or defend legal claims.

Cross-Border Transfers

Your personal data may be transferred to jurisdictions outside the area defined by local data protection laws, which are considered “cross-border transfers.” This may include transfers outside the European Economic Area (EEA) within the scope of EU law or outside the territorial boundaries of other countries under their respective data protection laws.

Such transfers will only take place:

  • when necessary or legally required,

  • when you have explicitly consented, and/or

  • in connection with our contractual obligations towards you.
     

We have implemented appropriate safeguards for such transfers, including transfers to countries recognized as providing an adequate level of data protection, the use of data processing or data transfer agreements based on standard contractual clauses, and other equivalent safeguards recognized or required under applicable law to ensure an adequate level of data protection.

7 Data Security

PERI is committed to protecting your personal data and implements all necessary technical and organizational measures to ensure an appropriate level of protection. Our employees and service providers are contractually obliged to maintain confidentiality and comply with applicable data protection laws.

In particular, we implement appropriate safeguards to protect your personal data against unauthorized access, loss, destruction, alteration, or disclosure.

These measures include, among others:

Administrative measures, such as internal data protection policies and regular employee training;

Technical measures, such as access controls and authorization management, encryption of personal data, secure logging, antivirus software, and other IT security programs;

Physical measures, such as access restrictions to IT systems, server rooms, and data archives.

Our security measures are continuously improved in accordance with the state of the art.

8 Data Retention and Deletion

We do not retain your personal data longer than necessary to provide our goods and services, fulfill the purposes set out in this Privacy Notice, and comply with legal obligations.

Unless exceptions arise due to unforeseen dispute resolution or legal claims, we adhere to the following specific retention periods, which are regularly reviewed to ensure continued compliance and relevance:

Contact and company information:
These data are processed for the execution and documentation of the partnership and are retained after the end of the partnership for the duration of applicable commercial retention and documentation obligations.

Transaction information:
Your transaction information is retained in accordance with accounting and tax laws as well as our internal group accounting requirements.

User account information:
Your user account information will be removed no later than 13 months after the end of your use of our service. Information processed for logging and security monitoring purposes is retained only as long as necessary for system operation and securely deleted when the system is decommissioned.

Website usage and technical data:
These data are primarily processed during your visits to our websites or services. For further details on the retention and storage of these data through cookies and similar technologies, please refer to Section 4.

Personal image:
Your personal image processed with your consent is retained in accordance with the conditions set out in the consent declaration, fully taking into account legal requirements regarding personality rights and copyright law. Event recordings, such as photos or videos taken during your participation in events (where we make best efforts to avoid making individual persons identifiable), are processed and stored in accordance with the rotation concept for marketing materials and the information communicated in our on-site notices.

Social media information:
Social media posts and interactions are processed in accordance with the terms of the respective social media platform. Further information about the privacy policies of these platforms can be found in Section 5.

Event participation information:
Your event participation information will be deleted once it is no longer required for event follow-up activities and no legal retention or limitation periods apply.

9 Data Subject Rights

If you wish to exercise your data subject rights, you may contact us at any time using the contact details provided in Section 1 of this Notice.

You have the following rights regarding your personal data:

Right of access:
You may request confirmation as to whether personal data concerning you are being processed and, if applicable, obtain a copy of such personal data.

Right to data portability:
You may request the personal data you have provided to us in a machine-readable format, subject to applicable legal conditions.

Right to erasure (“right to be forgotten”):
You may request the deletion of your personal data under the conditions permitted by law.

Right to rectification:
You may request the correction of inaccurate personal data and the completion of incomplete personal data.

Withdrawal of consent:
You may withdraw any consent you have given for the processing of your personal data at any time without affecting the lawfulness of processing based on consent before its withdrawal.

Right to object:
You may object to the processing of your personal data under the conditions permitted by law.

Right to restriction of processing:
You may request the restriction of the processing of your personal data under the conditions permitted by law.

Right not to be subject to automated decision-making:
You have the right not to be subject to a decision based solely on automated processing — including profiling — which produces legal effects concerning you or similarly significantly affects you. Please note that our current practices do not involve such automated decision-making; should this change, you will retain this right and will be properly informed of such processing.

Right to lodge a complaint:
You have the right to lodge a complaint with your competent data protection supervisory authority or with the supervisory authority responsible for PERI’s registered office.

10 Changes to this Notice

We reserve the right to amend this Privacy Notice as necessary in order to adapt it to operational, technical, and legal changes. If material changes are made that significantly affect the processing of your personal data, we will inform you either individually or by publishing an updated notice on this website.
